ThunderMax Minimum Advertised Price (MAP) Policy
To protect the integrity of the ThunderMax® brand, and to support our network of authorized dealers and distributors, ThunderMax (“the Company”) has established this Minimum Advertised Price (MAP) Policy. This policy is designed to ensure fair competition and to maintain the value of ThunderMax products in the market.
1. Policy Overview: All resellers, dealers, and distributors of ThunderMax products are required to advertise ThunderMax products at no less than 100% of the published Manufacturer’s Suggested Retail Price (MSRP).
This includes all online, print, and digital advertisements, including:
• Product listings on websites or marketplaces
• Email marketing
• Paid search ads
• Social media promotions
• Flyers, catalogs, and other printed materials
2. What This Policy Covers: This MAP Policy applies to all ThunderMax branded products, including but not limited to:
• ThunderMax ECMs
• iRIDE Suspension Systems
• Harnesses, accessories, and hardware
• Branded merchandise
The current MSRP for all ThunderMax products is published on the website. ThunderMax reserves the right to update MSRP at any time.
3. What This Policy Does NOT Cover: This MAP Policy does not apply to the final sales price negotiated between a reseller and a customer in private. Resellers are free to sell products at any price in-store or via direct communication, as long as the advertised price remains at or above MSRP.
Additionally, this policy does not restrict:
• In-cart pricing that is not publicly viewable prior to checkout
• “Call for Price” or “Add to Cart to See Price” functionality
• Promotional bundles or value-add packages, provided the product itself is not advertised below MSRP
4. Enforcement & Violations: ThunderMax reserves the right to monitor advertised pricing at any time. If a reseller is found to be in violation of this policy:
1. First Violation: Written warning and request for correction
2. Second Violation: Temporary suspension of dealer account or purchasing privileges
3. Third Violation: Termination of dealership or reseller relationship
ThunderMax reserves the right to enforce this policy at its sole discretion and may take any corrective action deemed necessary without liability.
5. No Negotiation or Modification: This MAP Policy is unilateral and non-negotiable. ThunderMax does not seek agreement from any reseller to comply with this policy. It is not an agreement and is not subject to discussion, modification, or joint action.
